Terms of Service

These Terms of Service ("Terms") govern your use of Lumiveil Studio's website located at lumiveilstudio.com and the photographic services provided by Lumiveil Studio LLC ("Studio," "we," "us"). By booking a session or using our services, you agree to these Terms in full.

1. Agreement to Terms

By accessing our website or engaging our services, you confirm that you are at least 18 years of age (or have parental/guardian consent if under 18) and agree to be bound by these Terms. If you disagree with any part of these Terms, you must not use our services.

2. Services

Lumiveil Studio provides professional portrait photography services including, but not limited to: Signature Portrait sessions, Cinematic Story productions, and Editorial Couple sessions. All services are subject to availability and require advance booking.

We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice. Service descriptions on our website are provided for informational purposes and may vary based on specific client arrangements confirmed in writing.

3. Booking & Payment

• All sessions require a non-refundable booking deposit of 50% of the total session fee to confirm your date.
• The remaining balance is due no later than 48 hours before your session date.
• Prices are quoted in USD unless otherwise stated in your session agreement.
• All prices are subject to applicable taxes based on your location.
• Payment is processed securely via Stripe. We do not store your payment card information.
• A detailed invoice will be provided for all transactions.

4. Cancellation & Rescheduling

Client Cancellations

• More than 14 days before session: Full deposit retained; balance refunded if paid
• 7–14 days before session: Full deposit retained; 25% of remaining balance charged
• Less than 7 days before session: Full session fee is non-refundable

Rescheduling

• One rescheduling request is permitted at no charge if made at least 7 days before the session
• Subsequent rescheduling requests are subject to a $150 administrative fee

Studio Cancellations

In the unlikely event that Lumiveil Studio must cancel a session, we will offer a full refund or priority rescheduling at no additional cost.

5. Image Rights & Licensing

• Upon full payment, clients receive a non-exclusive, personal-use license for all delivered final images.
• Images may be used for personal, portfolio, and social media purposes.
• Commercial licensing (advertising, editorial publication, product use) is available and must be negotiated separately in writing.
• Lumiveil Studio retains the copyright to all photographs and AI-enhanced images produced in the session.
• Clients may not alter, sell, sublicense, or transfer images without written consent from Lumiveil Studio.
• Credit to Lumiveil Studio ("Photography by Lumiveil Studio") is appreciated but not required for personal use.

6. AI Processing Consent

By booking a session, you acknowledge and consent to:

• Post-processing of your images using Lumiveil Studio's proprietary AI light-sculpting tools
• Internal analysis of image data for quality enhancement purposes only

You explicitly do NOT consent (and we will not) to:

• Use of your likeness to train any external AI model
• Sharing of your images with third-party AI platforms
• Any commercial application of your likeness beyond the agreed session deliverables

This consent may be revoked in writing at any time prior to gallery delivery, subject to reasonable limitations.

7. Portfolio & Marketing Use

Lumiveil Studio may wish to use select images from your session in our portfolio, website, and social media channels. This is subject to:

• Explicit opt-in consent, requested separately from these Terms
• Your right to revoke consent at any time; previously published images will be removed within 30 days of written request
• No commercial sale or licensing of your likeness without additional written agreement

Clients who opt out of portfolio use are still entitled to full, unaffected service delivery.

8. Client Conduct

During sessions, clients agree to:

• Treat all studio staff and equipment with respect
• Comply with health and safety guidelines at the studio or on-location
• Not bring unauthorized persons to sessions without prior written approval
• Arrive on time; sessions lost due to late arrival are not refunded

Lumiveil Studio reserves the right to terminate a session immediately if a client engages in abusive, threatening, or inappropriate behavior. In such cases, no refund will be provided.

9. Limitation of Liability

To the maximum extent permitted by law, Lumiveil Studio's total liability to you for any claims arising from these Terms or our services shall not exceed the total fees paid by you for the relevant session. We are not liable for indirect, incidental, consequential, or punitive damages of any kind.

We are not responsible for lost or damaged personal items brought to the studio or on-location, or for delays caused by circumstances outside our reasonable control (weather, third-party venue issues, etc.).

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, USA, without regard to its conflict of law provisions. Any disputes shall be resolved in the competent courts of New York County, New York.
